1Acceptance of Terms
By accessing or using SocialAI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SocialAI ("we," "us," or "our").
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. In that case, "you" and "your" will refer to that entity.
2Description of Service
SocialAI is an AI-powered social media management platform that allows businesses to automatically generate, schedule, and publish social media content by analysing their company website. The Service includes, but is not limited to:
• Automated social media content generation using artificial intelligence
• Multi-platform scheduling and publishing (LinkedIn, Twitter/X, Instagram, Facebook, TikTok)
• Brand voice analysis and website scanning
• B2B lead discovery and pitch email generation
• Analytics and performance reporting
• Content calendar management
• AI-assisted content editing and optimisation
The features available to you depend on the subscription plan you select.
3Account Registration
To access the Service, you must create an account by providing accurate, current, and complete information. You are responsible for:
• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account at support@socialai.app
You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.
4Subscription Plans and Billing
SocialAI offers multiple subscription tiers with different features and usage limits. By subscribing to a paid plan, you agree to the following:
4.1 Billing Cycle. Subscriptions are billed on a monthly or annual basis, depending on the plan you select. Your billing cycle begins on the date you subscribe.
4.2 Automatic Renewal. Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
4.3 Price Changes. We may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
4.4 Refunds. We offer a 14-day money-back guarantee for new subscribers on paid plans. After this period, subscription fees are non-refundable, including for partial months.
4.5 Free Trial. If we offer a free trial, it will automatically convert to a paid subscription at the end of the trial unless cancelled. We reserve the right to modify or discontinue free trial offerings at any time.
5Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner consistent with these Terms. You must not:
• Use the Service to generate spam, misleading, or deceptive content
• Post content that infringes on intellectual property rights of third parties
• Use the Service to harass, abuse, threaten, or defame any person or entity
• Attempt to gain unauthorised access to the Service, other accounts, or our systems
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools (bots, scrapers) to access the Service beyond its intended API use
• Resell, sublicense, or otherwise commercialise access to the Service without written consent
• Upload malicious code, viruses, or any software intended to damage or disrupt systems
• Generate content that promotes hate speech, violence, discrimination, or illegal activity
• Use the Service in any way that violates applicable local, national, or international laws
We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated this Acceptable Use Policy.
6AI-Generated Content
SocialAI uses artificial intelligence to generate content on your behalf. You acknowledge and agree to the following:
6.1 Review Responsibility. You are solely responsible for reviewing all AI-generated content before publishing. We strongly recommend reviewing every post, email, and blog article before it is published or sent.
6.2 Accuracy. We do not warrant that AI-generated content is accurate, complete, or appropriate for your specific business needs. AI can produce factual errors, outdated information, or unintended tone.
6.3 Ownership. Subject to your compliance with these Terms and payment of applicable fees, you own the content generated by SocialAI on your behalf. We do not claim ownership of your generated content.
6.4 Feedback and Improvement. We may use aggregated, anonymised data about how you use the Service to improve our AI models and the Service generally. We will not use your specific content to train our models without your explicit consent.
6.5 B2B Pitch Emails. When using the B2B pitch email feature, you are responsible for ensuring compliance with applicable anti-spam laws (CAN-SPAM, GDPR, CASL). SocialAI's approval workflow requires your explicit authorisation before any email is sent.
7Website Publishing Integration
SocialAI's website publishing feature allows you to connect your CMS or website platform to publish content directly. By using this feature:
• You grant SocialAI the necessary permissions to access and publish content to your connected platforms
• You are responsible for the accuracy of API keys, credentials, and webhook URLs you provide
• You acknowledge that publishing actions are taken at your direction and under your authorisation
• We are not liable for content published in error due to misconfigured integrations
• You may revoke SocialAI's access at any time through your account settings or directly via your CMS platform
Supported integrations include WordPress (REST API), Webflow (CMS API), Ghost (Admin API), Shopify (Blog Posts API), and custom webhook endpoints.
8Third-Party Services and Social Platforms
The Service integrates with third-party social media platforms (LinkedIn, Twitter/X, Instagram, Facebook, TikTok) and other services. You acknowledge that:
• Each social platform has its own terms of service that you must comply with independently
• We are not responsible for changes to third-party APIs, platform policies, or access restrictions
• Your use of connected social accounts must comply with the respective platform's rules
• We may lose access to certain platform integrations due to changes in their policies, and this does not constitute a breach of our service
We use third-party providers including Google Gemini for AI generation and Resend for email delivery. These providers have their own privacy policies and terms of service.
9Intellectual Property
9.1 Our IP. The Service, including its design, features, code, trademarks, and logos, is owned by SocialAI and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written consent.
9.2 Your Content. You retain all rights to your business content, website data, and any content you upload to the Service. By using the Service, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the Service to you.
9.3 Feedback. If you provide us with feedback or suggestions, you grant us a perpetual, irrevocable licence to use that feedback without any obligation to compensate you.
10Privacy and Data Protection
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal data. By using the Service, you consent to our data practices as described in the Privacy Policy.
We comply with applicable data protection laws including GDPR (for EEA users), CCPA (for California residents), and other relevant regulations. If you use the Service to process personal data of third parties (including B2B leads), you are responsible for ensuring your use complies with applicable privacy laws.
11Limitation of Liability
To the maximum extent permitted by applicable law:
• SocialAI is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or completely secure
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for the consequences of AI-generated content that is published without adequate review
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so some of the above may not apply to you.
12Indemnification
You agree to indemnify, defend, and hold harmless SocialAI and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
• Your use of the Service in violation of these Terms
• Content you generate, publish, or distribute using the Service
• Your violation of any third-party rights, including intellectual property or privacy rights
• Your violation of any applicable laws or regulations
13Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of material changes that affect your use of the Service. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may also update these Terms from time to time. We will notify you of significant changes via email or a prominent notice within the Service. Your continued use of the Service after such notice constitutes your acceptance of the updated Terms.
14Termination
14.1 By You. You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.
14.2 By Us. We may suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.
14.3 Effect of Termination. Upon termination, your right to access the Service ceases. We may delete your account data after a 30-day grace period. You may export your data before termination using the data export feature in your account settings.
15Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class or representative action.
